These Terms and Conditions (“Terms”) govern your access to and use of the Ingredient Guard mobile application, website, and related services (collectively, the “Service”) operated by Ingredient Guard (“Ingredient Guard,” “we,” “us,” or “our”).
By downloading, installing, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
Ingredient Guard is a free barcode scanning application designed to help users identify certain ingredients in packaged food products, including seed oils, artificial food dyes, and related additives.
The Service provides informational and educational content only.
Ingredient Guard does not manufacture, sell, test, certify, or verify food products.
2. No Medical, Nutritional, or Professional Advice
The Service does not provide medical advice, nutritional advice, dietary guidance, diagnosis, or treatment.
Information provided by the Service:
- Is for informational purposes only
- Is not a substitute for professional medical advice
- Should not be relied upon as the sole basis for dietary decisions
If you have food allergies, sensitivities, medical conditions, or dietary concerns, you must consult a qualified healthcare professional before making decisions.
You acknowledge that reliance on any information provided by the Service is solely at your own risk.
3. No Guarantees Regarding Accuracy
Ingredient Guard does not guarantee:
- That ingredient lists are accurate
- That product information is complete
- That flagged ingredients are always correctly identified
- That all relevant ingredients will be detected
- That food manufacturers have not changed formulations
Manufacturers may modify ingredients without notice.
You are solely responsible for verifying product labels before consumption.
4. Assumption of Risk
You expressly acknowledge and agree that:
- Use of the Service is voluntary
- You assume full responsibility for any dietary decisions
- You assume all risks associated with food consumption
- Ingredient Guard is not responsible for allergic reactions, illness, or injury
Your use of the Service is entirely at your own risk.
5. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, Ingredient Guard disclaims all warranties, express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Accuracy
- Reliability
- Non-infringement
- Availability
We do not warrant that the Service will be uninterrupted, secure, or error-free.
6. Limitation of Liability
To the fullest extent permitted by applicable law:
Ingredient Guard, its owners, affiliates, licensors, and service providers shall not be liable for:
- Personal injury
- Allergic reactions
- Health complications
- Loss of data
- Lost profits
- Indirect, incidental, consequential, punitive, or special damages
In no event shall our total liability exceed one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
7. Indemnification
You agree to defend, indemnify, and hold harmless Ingredient Guard and its affiliates from and against any claims, damages, liabilities, losses, and expenses arising out of:
- Your use of the Service
- Your dietary decisions
- Your violation of these Terms
8. No Accounts or Payments
Ingredient Guard:
- Does not require accounts
- Does not collect payment information
- Does not offer subscriptions
- Does not provide in-app purchases
All app distribution occurs through the Apple App Store and Google Play Store under their respective terms.
9. Apple App Store Terms (EULA Compliance)
If you download the app from the Apple App Store:
- These Terms are between you and Ingredient Guard, not Apple Inc.
- Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support.
- In the event of a failure to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Your use of the app must comply with Apple’s applicable terms of service.
10. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration, rather than in court.
Arbitration shall:
- Be administered by the American Arbitration Association (AAA)
- Be conducted in the State of New York
- Be governed by the Federal Arbitration Act
The arbitrator’s decision shall be final and binding.
You waive the right to bring claims in court, including the right to a jury trial.
11. Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis only.
You waive the right to:
- Participate in class actions
- Act as a class representative
- Join claims with others
All disputes must be brought individually.
12. Jury Trial Waiver
If for any reason a dispute proceeds in court rather than arbitration, you waive your right to a jury trial.
13. Termination
We reserve the right to suspend, modify, or discontinue the Service at any time without notice.
We are not liable for any modification or discontinuation.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and Ingredient Guard regarding the Service and supersede all prior agreements.
